Abstract

ABSTRAK Nama : Fajri Hidayatullah NPM : 2019940016 Judul Tesis : Implementasi Kebijakan Perekrutan Tenaga Kerja Disabilitas di BUMD DKI Jakarta Dosen Pembimbing: Dr. Khaerul Umam Noer, M.Si Penelitian ini membahas mengenai “Peraturan Pemerintah Republik Indonesia Undang-undang No 8 tahun 2016 tentang penyandang disabilitas. Kebijakan bagi penyandang disabilitas dalam mendapatkan pekerjaan yang layak merupakan hak mendasar setiap warga negara Indonesia, hal ini diatur dalam Undang – undang Dasar 1945 pasal 27 angka (2). Kebijakan dan regulasi terkait hak tenaga kerja terhadap penyandang disabilitas di Indonesia sudah cukup memadai, namun jika dilihat secara keseluruhan belum berjalan optimal pada pelaksanaannya. Hasil penelitian di BUMD dan perusahaan swasta di DKI Jakarta selaku pemberi kesempatan kerja, belum mempekerjakan penyandang disabilitas sesuai dengan ketentuan regulasi yang ada dan belum melaksanakan kewajibannya dengan memberikan pemenuhan hak – hak pekerja disabilitas sebagaimana diatur dalam Undang – undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dan perda No.11 tahun 2010 mengenai penyandang cacat. Tujuan dari penelitian ini adalah Untuk memberikan informasi untuk mengetahui dan menganalisis mengenai kebijakan perekrutan pekerja disabilitas di dan BUMD DKI Jakarta, adapun metode penelitiannya menggunakan adalah deskriptif kualitatif yaitu suatu metode analisis data yang dilakukan dengan mengolah dan menganalisis secara sistematis, hasil dari penelitian menunjukan bahwa implementor belum menjalankan ketentuan regulasi yang telah ada, sehingga realita yang terjadi dalam perekrutan tenaga kerja disabilitas belum berjalan dengan maksimal, secara perekrutan dan penempatan, serta tidak terpenuhinya kuota yang telah di tentukan bagi disabilitas di BUMD dan perusahaan swasta. mereka belum melaksanakan pemenuhan hak – hak penyandang disabilitas dalam hal memberikan peluang kerja, memberikan pelatihan keterampilan dan mendapatkan pekerjaan yang layak tanpa adanya diskriminasi. Berdasarkan latar belakang yang sudah dijelaskan Penelitian ini berfokus pada “Implementasi kuota kerja bagi penyandang disabilitas”. Kata Kunci : Disabilitas, Implementasi Kebijakan, Tenaga kerja. The policy for persons with disabilities in obtaining decent work is a fundamental right of every Indonesian citizen, this is regulated in the 1945 Constitution article 27 number (2). Policies and regulations related to labor rights for persons with disabilities in Indonesia are adequate, but overall they have not been implemented optimally. The results of research in BUMD and private companies in DKI Jakarta as providers of job opportunities, have not employed persons with disabilities in accordance with existing regulatory provisions and have not carried out their obligations by providing fulfillment of the rights of disabled workers as regulated in Law Number 13 of 2003 concerning Manpower and Regional Regulation No. 11 of 2010 concerning persons with disabilities. The purpose of this study is to provide information to find out and analyze the policy of recruiting disabled workers in and BUMD DKI Jakarta, while the research method used is descriptive qualitative, namely a data analysis method carried out by processing and analyzing systematically, the results of the study show that the implementor have not implemented the existing regulatory provisions, so the reality that occurs in the recruitment of disabled workers has not run optimally, in terms of recruitment and placement, as well as not fulfilling the quota that has been determined for disability in BUMD and private companies. they have not implemented the fulfillment of the rights of persons with disabilities in terms of providing job opportunities, providing skills training and getting decent jobs without discrimination. Based on the background described, this research focuses on “Implementation of work quotas for persons with disabilities”. Keyword : Manpower, Persons with Disabilities, Regulatory Provisions.
